1. Introduction and Acceptance
These Terms of Use ("Terms") govern access to and use of Komento.ai and the associated web application app.komento.ai (collectively, "the Service").
The Service is operated by the Publisher, as identified in the Legal Notices available on the website.
By accessing or using the Service, the User acknowledges having read, understood and accepted these Terms without reservation.
Any use of the Service implies full acceptance of the Terms.
2. Definitions
For the purposes of these Terms:
- The Publisher: the entity operating the Service, as identified in the Legal Notices.
- The Client: any individual or legal entity with an active free or paid account.
- The User: any individual accessing or using the Service, including persons authorised by the Client.
- Connected Page: any Facebook or Instagram Page voluntarily linked to the Service by the User through OAuth.
- Facebook Data: information retrieved from Meta via API requests or Webhooks (comments, posts, metadata).
- Client Data: configuration data, moderation rules, banned words, Pages connected by the Client.
- Derived Data: analytical outputs generated by Komento (scores, classifications, categories, summaries).
- Token: an access token issued by Meta enabling interactions between Komento and the Connected Pages.
3. Purpose of the Service
The Service provides the following capabilities:
- import and centralisation of comments from Connected Pages
- automatic moderation (hiding) based on Client-defined rules
- manual moderation (hide / unhide actions)
- algorithmic analysis and AI evaluation (toxicity score, summary, classification, categorisation)
- dashboards and statistics
- advanced search across comments
- multi-page management
- ability to set banned words
- ability to customise an AI prompt influencing analysis behaviour
- access to comment history
The Publisher may modify, enhance or remove certain features at any time, without compensation.
The Service does not allow:
- deleting comments on Facebook/Instagram
- replying to comments
- publishing posts
- sending private messages
- interacting as a personal profile
- performing unauthorised automated actions
- using data for advertising purposes
- training external AI or LLM models
- circumventing Meta policies or moderation systems
4. Access Requirements
The Service is accessible:
- via a modern web browser
- after creating an account
- after Meta OAuth authentication
- only if the User is a legitimate administrator or editor of the Connected Page
- in full compliance with these Terms and with Meta's policies
The Publisher may verify administrative rights at any time.
5. Compliance with Meta Policies
Use of the Service requires strict compliance with the following documents:

Any breach, or suspected breach, authorises the Publisher to immediately suspend access to the Service.
Meta may at any time modify, restrict or revoke permissions, which may impact the availability or functionality of the Service.
6. Accounts and Credentials
The Client is responsible for:
- creating and managing User accounts
- defining internal access permissions
- maintaining confidentiality of login credentials
- all actions performed using those credentials
Any loss, theft or unauthorised use must be reported immediately.
The Publisher shall not be liable for misuse resulting from the Client's failure to secure credentials.
7. User and Client Obligations
The Client and User agree to:
- use the Service only in compliance with applicable laws
- connect only Pages they legitimately administer
- comply with Meta policies at all times
- configure moderation rules responsibly
- verify moderation actions and results
- assume full responsibility for all moderation decisions
- refrain from attempting to conceal illegal content
- refrain from exporting Facebook Data to non-compliant tools
8. Strictly Prohibited Activities
It is strictly forbidden to use the Service for:
8.1 Scraping and unauthorised data extraction
- large-scale extraction or harvesting
- automation through bots, scripts or headless browsers
- using Komento to bypass Meta APIs
- extracting data for competitive, advertising or unlawful purposes
8.2 Reverse engineering
- decompiling or attempting to access source code
- analysing internal logic, models, or processes
- circumventing security measures
8.3 Service replication
- creating a competing service based on Komento
- reproducing the interface, design, workflows or algorithms
- automated benchmarking
- analysing or observing the Service for competitive intent
8.4 External AI training
Users are strictly prohibited from using data from the Service to train:
- AI models
- LLMs
- machine learning systems
- external analytics platforms
8.5 Political or unlawful activities
Including but not limited to:
- political campaigns
- influence operations
- misinformation
- hate, harassment, or illegal content
- targeted manipulation
9. Hosting and Security
Data is hosted in secure data centres compliant with international standards (ISO 27001 / SOC 2) via the Publisher's technical partners.
The Publisher implements:
- encrypted communications (HTTPS/TLS)
- internal backups
- access logging and monitoring
- intrusion protection
- internal security and confidentiality policies
In case of a security incident affecting user data, the Publisher will notify the Client as soon as reasonably possible.
10. Moderation Capabilities and Responsibilities
The Service only performs actions permitted by Meta:
- hide a comment
- unhide a comment
- analyse, classify and score comments
The Publisher does not guarantee:
- accuracy of AI analysis
- reliability of classifications
- absence of false positives or false negatives
- continuous availability of Meta APIs
- future stability of permissions or features
The Client remains fully liable for:
- automatic hiding rules they configure
- all manual moderation actions
- consequences of moderation decisions
- impacts on engagement, visibility or communication
11. Suspension and Termination
The Publisher may immediately suspend access in cases of:
- breach of these Terms
- suspicious or fraudulent activity
- violation of Meta policies
- scraping or reverse engineering attempts
- illegal or dangerous use
- request from Meta or a competent authority
The Publisher may terminate an account without providing justification, with reasonable notice, except in cases of serious breach (immediate termination).
The Client may delete their account at any time.
12. Service Availability
The Service is provided on a best-effort basis.
The Publisher does not guarantee:
- uninterrupted access
- error-free operation
- continuous compatibility with Meta APIs
- stability of Webhooks
- performance of third-party infrastructure
13. Limitation of Liability
13.1 Professional users
The Publisher's total liability is strictly limited to:
- a prorated refund for the affected period,
- with no further compensation,
- and capped at a maximum of 0 XPF beyond said prorated refund.
Excluded from all liability:
- indirect damages
- commercial losses
- loss of revenue or engagement
- data loss resulting from Meta API behaviour
- reputational losses
- issues arising from moderation decisions
- consequences of Meta permissions being altered or revoked
13.2 Non-professional users
The only applicable remedy is a prorated refund for downtime.
No additional compensation is owed.
14. Intellectual Property
The Service, its source code, interfaces, algorithms, internal models, databases and design elements are the exclusive property of the Publisher.
Any reproduction, extraction, modification or redistribution is prohibited.
15. Personal Data
Processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms.
16. Governing Law and Jurisdiction
These Terms are governed by the laws applicable in New Caledonia.
Any dispute shall be submitted to the Commercial Court of Nouméa.
